Tattoos and Regulation

As previously discussed, tattoo studios are regulated under the Local Government (Miscellaneous Provisions) Act where local authorities are able to enter premises at any time and check that health and safety is being upheld according to regulation. The Tattooing of Minors Act of 1969 also prohibits a tattooist from doing a tattoo on an individual under the age of 18. Proof of identity and age must be recorded. 

Particular laws that impact tattooist include The Health and Safety at Work Act (HSWA, 1974); The Local Government (Miscellaneous Provisions) Act 1982 ( now amended by the Local Government Act 2003); The Tattooing of Minors Act of 1969; The Medicines Act of 1968 relating to anaesthetics; Laws relating to age, consent, assault and special treatments; and The Prohibition of Female Circumcision Act (1985).

Legally, tattooists are also bound to ask questions about health because tattooing can have serious implications for people with certain health conditions. Such questions include whether or not a woman is pregnant because having a belly tattoo or breast tattoo can have complications for the gestation period and birth. Women should be advised on the risks. All studios are also meant to provide aftercare recommendations and contact information for questions.
